The 90 Day Unemployment Limit on STEM OPT Is Not a Countdown You Can See — And That Is the Problem

Most STEM OPT candidates know there is a 90 day unemployment limit but very few understand how quietly and invisibly those days accumulate until it is too late. There is no dashboard, no alert, no email from USCIS telling you that you are at day 45 or day 78 — you are entirely responsible for tracking it yourself and if you hit 90 days without realizing it your status is already compromised. Days start counting from gaps between jobs, from the time between your OPT start date and your first day of employment, and from any period where your work arrangement does not meet the requirements — including roles that are unpaid, not related to your degree, or with employers not on E-Verify. A lot of candidates discover they are over the limit only when they try to apply for STEM OPT or when a problem surfaces during a background check. Start counting from day one, track every gap honestly, and if you are getting close to that number talk to your DSO and an attorney before you hit it not after.
