STEM OPT Compliance

What Happens to Your STEM OPT If You Work Remotely From a Different State Than What Is on Your I-983

Remote work has made this one of the most overlooked compliance issues for STEM OPT candidates right now. When you filed your STEM OPT application your I-983 listed a specific work location — and if you are now working from a different state because you moved or because your employer went fully remote that location change may need to be reported and documented. Some location changes require a new I-20 and updated SEVP reporting, and if you are working from a state where your employer does not have a registered business presence it creates additional complications around tax withholding, payroll compliance, and your employer's ability to legally employ you there. Most candidates move states without thinking twice about what it means for their STEM OPT paperwork because nobody brings it up during onboarding. Before you pack your bags and set up your home office in a new state have a conversation with your DSO and confirm what reporting obligations are triggered by that move.
